Process servers must ask defendant if he/she is currently on active duty in the military, or dependent upon anyone who is.  If the defendant is on active duty you may serve them, however, process server must collect additional information.

Active Duty Defendant — Additional information needed

  • What branch of the military is defendant serving with?
  • Where is defendant stationed?
  • Obtain the name and number of defendant’s commanding officer?
  • Obtain copy of the deployment orders
