Nail and Mail Guidelines (CPLR 308 (4) – When pleadings are taped to the door of the defendant’s residence or usual place of abode following diligent attempts to serve the defendant the following guidelines must be followed: Nail and Mail is not allowed at a defendant’s place of business unless they are the principle owner.

Verification – Process Server must verify with a neighbor that the defendant does reside at the address.

Military Verification – Process Server must verify with a neighbor that the defendant is not in the military.

Due Diligent Attempts – Process Server must make a total of three (3) attempts, an early morning (before 8:00 am) a mid-day attempt (between 9 a.m. and 5 p.m.) and an evening attempt (after 6:30 p.m.) Undisputed Legal also encourages a Saturday attempt, however this is not required.

Descriptive Information – Process Server must provide the description and location of the neighbor who verified information, and provide name of neighbor if possible

Photographs – Process Server must take photo’s of documents taped on the door.
